Beware! Your policy may not be in conformity with IRDAI guidelines

Beware! Your insurance company may be incorporating some clauses in the policy which are not in conformity with the approval granted by the Insurance Regulatory and Development Authority of India (IRDAI).

According to Insurance Ombudsman, Virander Kumar, insurance holders should check the website of IRDAI for terms and conditions of the policy under the Free Look Option before going in for the policy.

Citing an expample where a private insurance firm rejected to play claims to the relatives of the insurer, who was murdered, Kumar said that the company said that they could not pay the claims as the insurer was murdered. “As per the terms and conditions of the insurance company, the claims could not be paid to the family of insured as it is culpable homicide,” said Kumar.

Interestingly, the Ombudsman sought the initial terms and conditions which were approved by IRDAI from the insurance company. “It seems they did not have the clause when they got IRDAI approval. This was incorporated without IRDAI approval,” said Kumar.

“As a result we asked them to pay Rs 10 lakh to the insured,” he said. However, there are also several cases of insurance firms rejecting to pay the claim on rather flimsy grounds.

He says that ususally the insurance company never provides details to the insured on various charges in the policy. Although it is mandatory for the insurer to provide annual statement of funds, it is hardly gicven, he says.

Citing another case of a private insurance company which tried to cheat a 60-year-old insurer after insuring him for lieftime. “This was repudiation of death claim of the life assured. The company rejected the claims stating that there are no funds despite the insured paying the annual premiums for the last five years as per the premium paying terms of the policy,” said Kumar.

“When probed, it was found that the insurance company was charging 300 per cent mortality charges without the consent of the insured. The policy continued when there was no fund value to cover the mortality charges. It was terminated five years ago without the consent of the insured. This too when the premium was insufficient to cover the monthly charges for the full year” said Kumar

Interestingly, when the Ombudsman sought the details about the confirmation of the product approval of IRDAI along with policy wording, terms and conditions, the insurer failed to provide it. “However, they found it convenient to settle the claim on August 13, 2015 by paying a settlement of Rs 24.75 lakh and the complainant withdrew the complaint” said Kumar.

He said that many individuals who brought the policies may be facing the same plight but they don’t know how to approach. “We reject 50 per cent of complaints as they don’t approach the insurer first,” said Kumar.

Kumar also blames the insurance companies. He says while scrutinising most of the complaints, it was found that most of the complaints received by insurers are not acknowledged and many are not responded to.

He says in many cases the claims settling officer and the grieance officer are one and the same which is violation of IRDA regulations.

Talking about Chennai, Kumar says that the office of Chennai Insurance Ombudsman received 1513 complaints during 2014-15 and disposed of 1527 complaints, including 14 complaints outstanding at the beginning of the year. “Chennai is the only Centre with Nil pendency,” he added

Now a person living in rural Tamil Nadu who doesn’t have Internet access could shop online through the help of rural post offices.

This comes after India Post has rolled out e-commerce bandwagon with mVikarsha Mobile Solutions to offer assisted online shopping in rural Tamil Nadu.

Mervin Alexander, PostmasterGeneral, Chennai City Region, told Express that this tie-up will benefit the rural custoers as they have the choice to select from a list of 1,000 items.

India Post has taken on the m-Commerce bandwagon through their tie-up with mVikarsha. After an initial pilot at two postal divisions, mVikarsha got the concurrence for expanding to full Tamil Nadu circle across all their Head post offices and Sub post offices. 

A Memorandum of Understanding was signed with mVikarsha Mobile Solutions to provide assisted ecommerce services on the mVikarsha rural ecommerce platform mVPaytm, through their Head Post offices and Sub Post offices, Alexander added. 

“The villager will have to come to the post ofiice to place the order. The postal department official will log on on behalf of the customer and place the order.” he said.

“Once the order is placed, the item will be delivered to the post office and the customer will recieve an SMS,” says Alexander.

Initially, this service will be provided in 500 post offices. “This service will be offered only in rural areas as part of our effort to bridge the digital divide,” says Alexander.

To a query on what would be the revenue earned through this venture, Alexander said that it is too early to come to conclusion. “It all depends on the patronage. After three months, we will get an idea,” he said.

“We wil be getting revenue through postal charges as well as commission from e-payment,” he added.

Interestingly, this comes at a time when usage of social media in rural India is growing. A report states that social media in rural Tamil Nadu has grown by nearly 100 per cent during the last one year with several million users residing in that belt fuelling the desire to buy essential, aspirational and life style items in that order. 

The items include mobile phones, gold coins and jewellery, apparels, home and kitchen appliances, consumer durables, rechargeable lights, fans etc

16,631 cases pending before family courts in Chennai

Chennai:

A total of 16,631 cases are pending before Family courts in Chennai and this is continuously rising, according to information provided by Amicus Curaiae R Y George Williams.

The information was filed in Madras High Court after Justice N Kirubakaran directed the State government and the registrar general to provide a report with the details of number of cases filed each year.

The information that a total of 5,280 cases are pending at Additional family Court I, 4,543 cases in additional family court II , 4,384 cases at additional family court III and 2,424 cases at Principal Family Court.

The Amicus Curaiae submitted that after the establishment of family courts at Chennai, more than 32,000 have been filed from the period 2011-2015 (Till August 14).

He also submitted that family courts should have infrastructure similar to that of small causes court of Chennai with separate administrative control under the post of chief judge and registrar.

During the hearing, Justice N Kirubakaran said that Ayyadurai, standing counsel of Madras High Court has produced letter written by registrar general, which was addressed to principal secretary to pass necessary order for sanction of four additional family court for Chennai alone.

“Copy of the order has been produced before this court as well as served on additional advocate general to get 10 days time instruction,” the judge said while adjourning the hearing to September 10.

IGCAR gets new director

Chennai:

Distinguished Scientist and Director, Electronics & Instrumentation and Radiological Safety Group Dr S A V Satya Murty will be the new director of Indira Gandhi Centre for Atomic Research and Director of General Services Organisation of Kalpakkam from Tuesday.

He succeeds Dr P R Vasudeva Rao.

Satya Murty is a University Gold Medalist in B.Tech from Jawaharlal Nehru Technological University, Kakinada and is from the 21st Batch of the Training School.

He obtained his doctoral degree from Homi Bhabha National Institute and made pivotal contributions in establishing efficient computer network and high end computer systems.  

Under his guidance, the group has contributed towards establishing indigenous Instrumentation and Control systems for the Prototype Fast Breeder Reactor nearing commissioning at Kalpakkam.

His efforts resulted in establishing unique facilities like, PFBR Operator Training Simulator and Advanced Visualization Centre at IGCAR. His work on Wireless Sensor Networks has gained international recognition and he is coordinating one of the IAEA projects aiming at enhancing the application of wireless sensor networks in the nuclear reactor domain. He is also piloting the development of Time Domain Electro Magnetic System, which enables efficient method for identifying uranium mineral sources in the country
