CMDA seals three buildings in George Town

Chennai Metropolitan Development Authority on Friday sealed three buildings located in George Town area in a bid to comply with Madras High Court directions.

The buildings are among the 165 buildings which were given lock and seal notice by Chennai Metropolitan Development Authority. Two of the buildings are located at Anna Pillai Street and one at Coral Merchant Street.

CMDA officials refused to divulge any details about the three buildings, which was sealed as per the provisions of Section 56 and 57 of Tamil Nadu Town and Country Planning Act, 1971. 

Interestingly, Madras High court has stated that Appeals available under Section 79 (Any person aggrieved by any decision or order of the planning authority under section 49 may appeal to the prescribed authority) and Section 80-A ( where the action to lock and sea the building can be modified) are freely used by illegal building owners to stymie possible adverse action by the authorities.

The appeal provisions are abused in instances where construction is clearly illegal (as for example constructing additional floors which are not permissible) and in that sense resulting in abuse of law, the Madras High court has observed.

CMDA has till now surveyed 706 of the total 2,674 buildings of which 165 were served lock and seal notice while 11 were sealed.
