Unauthorised constructions in city threatens ground water recharge pattern, says CPCB report

The unauthorised construction by city based developers in several parts of the city without obtaining environmental clearance could threaten ground water recharge pattern as well as sea water ingression in coastal areas, according to a report by Central Pollution Control Board chairman who heads the expert committee appointed by National Green Tribunal to assess the ecological and environmental damage.

The report, which is submitted to NGT Delhi by the committee recently, was to assess damages caused by the city based developers in 13 sites after petitions were filed by Manoj Misra, a former Indian Forest Service officer and convener of Yamuna Jiye Abhiyaan, and SP Muthuraman, an environmental activist.

This comes in the wake of National Green Tribunal levying a penalty of Rs 76.192 crore on seven private builders in 2015 for raising unauthorised structures which was in violation of the Environment Protection Act 1986.

The report was prepared after the visit to the sites of developers VGN Builder Private Limited, Y Pondurai, Jones Foundatio, SAS Realtors, Dugar Housing, SPR and RG Constructions, Anjli Infra Housing, Ankur Khusal Construction, Ambattur Realty Private Limited, ETA Properties and Investment, Ruby Manoharan Property Developers, Appaswamy Real Estates and Shivani constructions.

The report stated that in many cases, the construction has been carried out below the water table, which has every probability of impacting the hydrology of the area. “There will be a breach of previous layer of top acquifer as well as reduction in recharging area due to construction,” the report added.

It also castigated the authorities for failing to conduct any study while according permission. “No assured water supply was available at any of the site except for few,” the report stated.

“Abstraction of ground water beyond the recharging rate has every possibility of sea water ingression as such it is imperative to monitor the ground water level and water quality by accredited third party or Central Ground Water board,” the report added.

The report said that sewage treatment plant created by developers Y Pondurai, SAS Realtors and Ruby Manoharan Property Developers, Anjali Infra Housing, ETA Properties and Investment Private Limited, Shivani Constructions, Appaswamy Real estates and Ambattur Realty does not have headroom or safe access to the units for proper operation and maintenance. “They need to be demolished for providing space for safe accessibility for operation and maintenance,” the committee observed.

The report also highlighted lack of solid waste management at the sites. The committee also observed that building permission to projects should be granted only after environmental clearance. It also suggested that environment clearance should be integrated with building permission.

Recommendations of the committee:

1. Need to integrate environmental concerns in building permission itself

2. Need for mechanism where in facilities created for treatment of sewage, solid waste management, rain water harvesting are sustainable in long run

3. Ground water level should be monitored by accredited third party or Central Ground water Board

4. Sewage treatment plants should be constructed aboe the ground to have easy access to the plant

5. Any exploitation of ground water quality beyond the recharging rate has all probability of sea water ingression thus increasing the TDS level

Findings

1. Construction was started without obtaining environmental clearance 

2. Violated condition of obtaining environmental clearance before starting construction at site as envisaged in conditions stipulated by CMDA
