CMDA survey reveals 3,080 illegal buildings in George Town area

Chennai Metropolitan Development Authority has found that 3,080
buildings in George Town area have violated the planning norms as per
the preliminary survey carried out in 30 streets.

The survey of buildings was conducted on streets with a width of nine
metre and above. Interestingly, there are 479 streets in George town
area of which 30 have a road width of nine metres and above.

During the survey it was found that the buildings with violations
include 996 ordinary buildings, 1553 special buildings, 471
multi-storeyed buildings and 60 institutional buildings.

Of the violations, 2904 buildings have been classified as violating
Floor space index, 439 for height, 439 for road width violations
besides 3,051 for setback violations and 2215 for parking violations.

CMDA also said that the state government is constituting a committee
to frame fresh guidelines and rules after Madras High Court struck
down the guidelines and rules issued under Government Orders 234 and
235 of Housing and Urban Development department while upholding the
introduction of Section 113-C of Town and country Planning Act.

As such the buildings constructed prior to July 1, 2007 are eligible
for exemption under Section 113-C, CMDA stated. “On framing the
guidelines and Rules, the buildings which are entitled can be listed
out and for the remaining violated buildings action can be initiated,”
CMDA stated.

Interestingly, CMDA has suggested that once the guidelines under
Section 113-C is approved, a detailed survey could be done for
individual buildings for working out regularizable deviations to the
approved plan and violations of development regulations. CMDA said
that property owners should submit evidence for having completed the
building prior to July 2007. So that enforcement action could be
initiated against violated buildings or portions.

Interestingly, CMDA also highlighted the shortage of manpower in
carrying out a detailed inspection of the 3,080 buildings. “For
carrying out detailed inspection of the building plan and records, it
is estimated that a personnel can effectively survey one building per
day,” CMDA stated.
