Monitoring Committee seeks clarity on Section 113 C

The Monitoring Committee on Friday wanted clarity on Section 113 C and sought judicial sanction before exempting buildings developed on or before July 1, 2007.

At a meeting held here on Friday, the non-official members expressed concern that the issue was not consulted in the monitoring committee. Sources said that the government has informed the Supreme Court that Regularisation Scheme is one time affair with the cut-off date Februray 28, 1999. But now it has passed the act to exempt the buildings developed on or before July 1, 2007.

Monitoring Committee member Deivasahayam said now it is for the High Court to give judicial sanctity on whether buildings built after Feb 28, 1999 to July 1, 2007 could be regularized.

He said the cut-off date of July 2007 clashes with the cut off date of February 1999 prescribed in High Court orders dated August 23, 2006. Interestingly, monitoring committee on Friday cleared two proposals of building built before 1999.

Interestingly, this comes in the wake of state government passing guidelines under Section 113-C of Tamil Nadu Town and Country Planning Act, 1971 earlier this month for the exemption of unauthorised buildings from regulations. The guidelines will cover any building developed on or before July 1, 2007 and deviated from Floor Space Index, setback requirements and road width of the Tamil Nadu Town and Country Planning Act, 1971.

The monitoring committee also discussed involving architects and academic institutions in enforcement to curtail illegal buildings.
