The Madras High Court on Saturday adjourned the hearing on frequent transfers of All India Service (AIS) officers by the Puducherry government to March 13.
The hearing was adjourned by the first bench comprising of acting chief justice Satish K Agnihotri and Justice M M Sundaresh after the additional solicitor general P Wilson sought time before the court.
The petitioner K Deivanayagam, president of Pondicherry Origin Adi Dravidar Rights Protection Movement in Reddiapalayam, Puducherry in his affidavit urged the court to issue writ of Mandamus direction to the Union home secretary and chief secretary of Puducherry to constitute a Civil Services Board to recommend transfers and postings of senior officials by forbearing the respondents from transferring any officer belonging to AIS prior to their completion of tenure of two years in compliance with Supreme Court judgement.
He said that the Union Home secretary has been taking speedy steps to transfer the incumbent chief secretary of Puduchery although he has hardly served for nine months. He also stated that the previous chief secretary too was transferred before she completed two years.
“The transfer is being affected by the Union Home secretary and not upon the recommendation of Civil Service Board as such it is without jurisdiction,” he stated.
“If an interim order is not passed, public interest will be impreilled, as governance would be a casualty,” the petitioner stated
