Madras High Court has issued three weeks notice to health secretary and registrar of Tamil Nadu Dr MGR Medical University over a plea by medical interns seeking weekly off and government holidays besides eight hours duty pattern in Tamil Nadu.
The first bench comprising of acting chief justice Satish K Agnihotri and Justice M M Sundaresh ordered three weeks notice to the respondents following a petition filed by Interns and Post Graduate Association of Tamil Nadu.
The petitioner stated that they are compelled to work 24 hours continuously during their internship without weekly off and government holidays.
They said this is violative of the right guaranteed to the petitioner under Article 14, 19 and 21 and 42 of the constitution of India.
Stating that medical interns are provided with eight hours duty and weekly off in various states, the petitioner argued that in Tamil Nadu there are no regulations and the medical interns are compelled to work 24 hours at a stretch.
The petitioner also pointed out that the regulations of the university on undergraduate and post graduate education clearly stipulate that one year of course means 240 workings days and only 85 per cent attendance.
“While this being the factual position of available regulations, the action of the respondents in compelling medical interns to work for 24 hours without any weekly off and government holidays is totally unjust, arbitrary and violative of statutory regulations.
