Madras High court has dismissed petitions that sought permission
to conduct dance programmes in temples during the festivities and renewal of
licence for conducting dance programmes in hotel.
Justice V Ramasubramanian while dismissing a batch of
petitions to allow cultural and dance programmes during festivals said that None
of the writ petitioners has anything to do with the management and
administration of the temples in question.
“The writ petitioners are private individuals who seek to
make use of the temple festivals, certainly not for propitiating the presiding
deities of those temples, but for arousing basic instincts of those who
assemble under the garb of devotees,” the judge observed.
It also dismissed a petition by C Muthupandi of Hotel
Platinium Stars seeking court direction to grant a public resort licence. “If
the Licensing Authority, on the basis of past experiences, comes to the
conclusion that the grant of licence is likely to result in depravation or
injury to public morality, the same cannot be found fault with by the Court
especially under Article 226,” the court ruled.
The Courts cannot overlook the fact that the police have
a duty not only to take corrective action after a crime is committed, but also
have a social obligation to take preventive measures. This is why the power to
issue orders under Section 144 of the Criminal Procedure Code is also conferred
upon the police, he observed.
