Madras High court has stayed a Single Judge order
directing the state to create additional seats in government related medical
colleges to accommodate students of DD Medical College and DD Hospitals in
neighbouring Tiruvallur district.
A bench comprising of justice M Jayachandran and justice M
Venugopal after hearing a writ appeal filed by Board of governors In
supersession of Medical Council of India stayed the order of justice K K Sashidharan.
In his order, Justice Sashidharan directed the Medical
Council of India (MCI) and the Tamil Nadu government to give admission to the
institution’s students of the 2011-12 and 2012-13 batches in government medical
colleges during the academic year 2014-15.
MCI has argued that the impugned order is erroneous as it
creates rights for illegally admitted students which are contrary to the law.
It also stated the order is erroneous in directing the appellant
to permit the state government to create additional seats in government medical
college for the year 2014-15 for the students of DD Medical College in 2011-12
and 2012-13 when the admitted position is that the admissions made in 2011-12
and 2012-13 were illegal.
MCI has also challenged the order stating that it is
erroneous in law and contrary to the facts and the law laid down by Supreme
Court and deserves to be set aside besides it has issued a mandamus to cure an
illegality which is not permitted.
