Madras High court has directed Tamil Nadu chief secretary to submit a
report by June 23 on whether there is any scheme available with the
state government for providing employment for the dependants of
members of armed forces who died while in service or whether there is
any such proposal.
The order was passed by Justice S Nagamuthu after hearing a petition
by Mary Metilda, wife of a soldier who died due to illness on December
2004.
Metilda submitted before the court that she has made an application
seeking employment on compassionate ground. Salem district collector
registered her name in the special register for legal heirs of
deceased military soldier.
She said that Commissioner and Engineer, Mettur municipality, wrote a
letter to the Salem collector to sponsor the name of candidates
waiting for appointment to fill up fopur vacancies of revenue
assistant in his office. The collector had forwarded the petitioner’s
name. The Mettur municipality commissioner rejected the collector’s
request stating that compassionate appointment order can be given
only in the same department where the employee died while working.
Justice Nagamuthu said that the court is not informed as to whether
there is any scheme available with the state government to provide
employment for the dependants of members of armed forces who lost
their lives while in service befitting their educational
qualification.
