Notice to TN to frame guidelines pertaining to safety of workers in thermal plants

Chennai:

Madras High court has been urged to direct Tamil Nadu government to
frame guidelines pertaining to occupational safety and health
regulation to be maintained by the industries.

Initiating suo motto proceedings, Justice M Jayachandran and Justice M
Venugopal issued notices to the state chief secretary, state labour
and employment secretary, energy secretary, health secretary, state
pollution control board chairman and state electricity board chairman.

This comes after Supreme Court on January 31, 2014, gave directions to
the High Courts to examine whether there are adequate and effective
health delivery systems in place and to evaluate the occupational
health status of workers in thermal power plants.

The state government has also been urged to appoint and constitute a
committee for monitoring of the working of thermal power plants in the
state and to keep a check on the health and safety norms for the
workers working in power stations.

Besides it has also been asked to direct the state government to pay
compensation to workers who are victims of occupational health
disorders and to frame a scheme of compensation for the workers in
cases of occupational helath disorders.

The High Court has also been urged to direct the state to notify the
recommendation filed by Occupational Health and Safety Association
before Supreme Court and the guidelines to be followed by the thermal
plants.

The Supreme court has in its  judgment stated that it would not be
practicable for the apex court to examine whether coal-based thermal
power plants across the country were complying with safety standards
and the rules and regulations relating to the health of employees in
such plants.

The High Courts in 18 States, including Gujarat, Uttar Pradesh,
Maharashtra, Madhya Pradesh and Tamil Nadu, have been asked to examine
these issues with the assistance of the State governments after
calling for necessary reports from the thermal power plants in their
respective States. The judges adjourned the hearing after two weeks.
