Head constable denied promotion illegally says HC



Chennai:

A head constable whose promotion as sub-inspector was denied for the
last 12 years has something to cheer about after High court ordered
the Police commissioner to reassess the ACR entry for 2002 and award
marks afresh within a period of four weeks.

After hearing a petition by head constable C Kumaran who fell short of
.5 marks to qualify for promotion as sub-inspector, Justice N Paul
Vasanthakumar and Justice M Sathyanarayanan said that there was an
error apparent on the face of the records in awarding of marks under
the head ACR to the appellant.

The judges said that the appellant was graded with ‘outstanding’ for
the year 2002, which is more than the grade ‘good’. As such the
appellant is entitled to get six marks as per the calculation where as
he was awarded only four marks, the judges noted.

“If the appellant is eligible to get additional 0.5 marks and the
prescribed cut off marks being 60/100, the appellant shall be given
promotion as sub-inspector (AR) and all other benefits as was given to
other persons, who were promoted as sub-inspectors for 2002, as the
appellant was illegally denied promotion without any fault on his
part.
