A contempt petition has been moved against Chennai Metropolitan Development Authority for failing to implement the order of Madras High Court with regard to promotion of an employee.
Judge M M Sundaresh has issued a notice to CMDA and posted the matter on Noember 18 after hearing a petition filed by Planning assistant R Shivakumar, who has submitted that CMDA has failed to honour the High Court order passed on November 7, 2014 asking to consider the petitioner for promotion within a period of eight weeks.
The judge had issued a direction to CMDA to pass appropriate orders on merits and in accordance with law within a period of eight weeks.
The petitioner submitted that he had made many representations to CMDA member secretary but nothing was forthcoming as a result he has moved the High Court.
Interestingly, the petition is being filed in the High court when CMDA has relaxed the service rules as well as qualifications to promote some of its officials. This was also mentioned in the audit report.
Citing a Madras High court judgment passed on July 2007 which has stated that the order of preference should be followed, the petitioner states that he is qualified from 2001 but was overlooked while CMDA relaxed norms to promote some of the officials, who did not possess the requisite qualifications.
