Chennai Corporation gave wrong info under RTI to shield illegal structures

Chennai Corporation officials are turning a blind eye to unauthorised buildings in Sowcarpet and many a times are providing false information under Right to Information Act to shield illegal structures.

Express is in possession of few RTIs given by Chennai Corporatiion to an RTI activists which appears to be false. “There has been instances where Chennai Corporation officials put the blame on other departments and at times say no inspection has been done despite clearly stating the violation,” says J Parasmal, an RTI activist.

Interestingly, this comes when the Madras High court has lamented about the unholy nexus between builders and officials.

In one particular case, regarding a building on  Thathamuthappan Street, the RTI activist has sought the reason on why no action has been taken against the illegal building. “The public information officer has stated that the appeal is pending before the housing and urban department,” said the activist.

Surprisingly, as per the information available through RTI from the Housing and Urban Development Department, there has been no appeal pending in government.

“The building is not built as per plan and when I sought the reason on why no action has been taken, they lie that the information is pending with some other department,” says Parasmal. 

Similarly, in another case, the officials replied to a query in RTI that they have not inspected the five-floor building in Narayana Mudalali street. “They say they have not inspected the building thenhow do they know  it is a five-floor buildingp,” said Parasmal.

Repeated attempts to contact Chennai Corporation officials failed. Meanwhile, action has yet to be taken against a seven-storied building which was sealed by Chennai Corporation for major violation last year. Nearly 10-months later, the building which is acknowledged by Chennai Corporation as having violated the development regulations is still standing tall and buzzing with activity.

“A notice was issued earlier but beyond that no action has been taken against the building,” said a corporation official.

Interestingly, this also comes when Chennai corporation submitted before the court that 

that it is facing 38 cases after taking up enforcement action against the illegal buildings.

Chennai Corporation commissioner Vikram Kapur has submitted before the court that Chennai Corporation has conducted a detailed survey of 1,655 buildings and called for plan notices issued to 1486 buildings.

The commissioner said that Chennai corporation has given de-occupation notice to 200 buildings.

The commissioner has also stated that Chennai Corporation has provided toll free number 18004251914 for in which the public can inform about their grievances and complaint. The number shall be used by the public to inform about the unauthorised deviated constructions within Chennai Corporation limits.

Chennai Corporation has stated that out of 11,304 buildings inspected by its officials in the Goerge Town area, only 72 buildings were found to have been built in accordance with rules. “From the preliminary surey that merely 1% of the buildings are built without any deviation,” the civic body had informed the court
