Chennai:
Madras High court has set aside a earlier order and upheld
the termination of constable by Central Reserve Police Force for suppressing
his involvement in a criminal case.
The order was passed by justice N Paul Vasanthakumar, who
set aside an earlier order passed on June 8, 2012 that quashed the termination
order passed by CRPF commandant and confirmed by additional DIG, CRPF.
Hearing a petition filed by additional DIG, CRPF and
commandant of 18 battalion, CRPF in Tura in Meghalaya, the judge said that the
constable while filling up the application has suppressed the fact of his
involvement in a criminal case registered by sub-inspector of police, east
police station, Thanjavur under section 294 (b) and 323 IPC.
Although it is not disputed that the constable was
acquitted giving the benefit of doubt after being charge-sheeted, the judge
observed that disclosure of involvement in a criminal case in the application
or attestation form is an essential requirement as honesty and integrity are
inbuilt requirements of police force.
