Madras High Court has dismissed the petition filed by BJP candidate for Nilgiris constituency S Gurumurthy challenging Election Commission order rejecting his nomination to contest Lok Sabha elections.
Election commission has rejected his nomination for submitting Form A & B a few hours late. Gurumurthy has said the defect can’t be termed substantial and nomination should have been accepted under Section 36 (4) of the Representation of People’s Act 1951.
The first bench comprising comprising acting chief justice Satish K Agnihotri and M M Sundresh observed that the petitioner can’t invoke jurisdiction of the court under Article 226 of the constitution of India for the purpose of challenging the rejection of nomination by the returning officer of the constituency. Accordingly, the writ petition is dismissed.
