Nadu, M S Jaffar Sait has moved the High court to direct the special judge
looking after cases under the Prevention of Corruption Act to return his seized
passport to perform pilgrimage (umrah) to Mecca and Medina on June first week.
In his petition before Justice Aruna Jagdeeshan, Sait
submitted that as his daughter’s marriage is solemnized on May 25, 2014, he
along with other family members have to undertake the pilgrimage.
“The petitioner who is the head of the family is the only
male member, A female member would be denied ‘Umra’ (pilgrimage) visa if she is
not accompanied by husband or blood related male family member,” Sait said.
As the validity of his passport, which is presently in the
custody of special court, has expired, he has to seek issuance of fresh
passport. “This could be done with an application to the passport authority and
submission of the original expired passport to the authorities. Apart from that
necessary No Objection Certificate is also to be obtained which would take
substantial time,” Sait submitted.
He also submitted that if he is denied the return of his
passport, it would be a deprival of his religious right and also his family
members who are eligible for a ‘Umra’ visa.
The judge issued notice to additional superintendent of
police vigilance and anti-corruption and Ministry of home affairs and adjourned
the hearing to April 10.
