Madras High Court has issued summons to 23 police officials to appear before the court on Tuesday for protesting before a court and abusing chief judge of Puducherry court for denying a bail to a sub-inspector arrested by Central Bureau of Investigation in a corruption case.
Treating the report submitted by the chief judge of Puducherry D Krishnaraja as a Suo Motu contempt petition, the bench comprising of acting chief justice Satish K Agnihotri and Justice K K Sasidharan summoned four superintendent of police, five inspectors, two sub inspectors, two home guards and 10 constables and head constables for staging dharna on the premises of Puducherry court on December 19,2008.
The police officials were demanding grant of bail to a sub-inspector Sridhar arrested on charges of receiving bribe of Rs 5,000 by CBI’s anti-corruption bureau. The judge had granted a bail to advocate Ambalavanan, another advocate arrested in the case while refused bail to Sridhar, the first accused in the case.
The report was submitted to the high court by the Judge on January 2, 2009 after High Court directed him to do so on December 22, 2008.
The chief judge in his report has stated that there is a deep rooted conspiracy instigated and encouraged by higher-ups in the police force in the rank of superintendent of police who are local officers to sound a caution not only against the judicial administration but also against the state and central administration to thwart any action either in the form of disciplinary action or in the form of prosecution being taken against the erring police personnel.
The judge in his report stated that higher police officials could not control the commotion and the police personnel who were responsible for maintaining law and order did not maintain any discipline and behaved like anti-social elements.
Meanwhile, Madras High court will also hear a petition against judicial enquiry being ordered by Puducherry government without the concurrence of High Court in the issue.
