HC issues notice to school edn secy over new fee structure for private schools

The Madras High Court has issued a notice to School Education secretary and member secretary of Private School Fee Determination Committee over a petition filed by Agarwal Vidyalaya Matriculation Higher Secondary School seeking interim stay on the new fee structure.
Justice Satish K Agnihotri and Justice KK Sashidharan issued a notice to a plea by the correspondent of the school S K Todi seeking an stay on the impugned order of fee structure by Private Schools Fee Determination committee.
Terming the fees fixed by the committee as irrational, arbitrary and unreasonable, the petitioner stated that there is no clarification or information sought on various aspects that are relevant for fixation of fees structure.
The petition stated that the committee while fixing fees lost sight of the fact that that the school has to comply with statutory requirements, comply with sixth pay commission recommendation on salary which is a basic factor.
The petitioner also stated that the committee also arbiatrily fixed the strength of staff at 83 whereas the actual strength including the principal is 101. Even the expenditure involved following the enhancement of salary to staff on implementation of sixth pay was not considered. This resulted in deficit amount of rs 75.95 lakh.
The petition said that the school has suffered a loss and likely to incur a loss for next three academic years. By the impugned order, the school claim on expenditure amounting to Rs 4.73 crore has been arbitrarily reduced to 3.01 crore.
The petitioner urged the court to issue a writ of Certiorarified, Mandamus or any other writ order calling for the record of the committee dated September 24, 2013 issued to the school and quash the same and direct the committee to refix the fee by considering the materials submitted on March 25, 2013.
Additional government pleader P Sanjay Gandhi took notice on behalf of School Fee Determination Committee.
