CMDA member secretary, CEO face Contempt of Court for failing to honour HC order to allow 23 traders to participate in lot system

Chennai Metropolitan Development Authority member secretary Karthik and chief executive office Kiran Guralla are facing contempt of court for failing to comply with Madras High Court order pertaining to allotment of shops in Koyambedu Foodgrains market.

Justice N Kirubakaran has ordered statutory notice for the appearance of CMDA member secretary and chief executive officer returnable by September 14, 2015 as they have failed to adhere to Madras High Court order where in the 23 traders, who had challenged cancellation of allotment orders, wre not allowed to participate in the drawal of lots despite Madras High Court order to do so.

The petition was moved by N Rajamohan who sought to punish the CMDA officials for having committed Contempt of Court by disobeying the order of Madras High court delivered on August 10, 2015. 

The petitioner is one among the 23 allottees, who was alloted a shop in the food grain complex in Koyambedu in the category of Non George town Traders Type I, which allotment was subsequently cancelled by order on June 30, 2015.

The peitioner had approached the court seeking a direction from the respondents to allow all the 23 cancelled allottees to participate in the drawal of lots held on august 11, 2015. The Madras High court then directed all the respondents to participate in the drawal of lots.

Surprsingly, the respondents were not allowed to take part. Interestingly, when Express asked a CMDA official, they said that they did not get the order copy.

During the drawal of lots, out of 473 shops, 452 were already alloted. Since most of the shops have been alloted, the chance of the petitioner getting revenue generating shop has been frustrated.
