Madras HC refuses to stay CSK suspension; To hear the case on September 23

Madras High Court has refused to stay Chennai Super King’s two-year suspension handed out by the Supreme Court-appointed Lodha committee but agreed to hear CSK petition on September 23 on the basis of merits and maintainability.

This would mean that working committee of Board of Control for Cricket in India could hold its crucial meeting on Friday at Kolkata.

The Division Bench of Chief Justice S K Kaul and Justice T S Sivgnanam while agreeing to hear the petition of CSK to quash the Lodha Committee’s order and direct the BCCI to permit the CSK to participate in IPL matches on September 23 has asked Cricket Association of Bihar, represented by Nalini Chidambaram, and BCCI represented by A L Somaiyaji to file a comprehensive counter affidavit which will include both preliminary issue and defence on merits. 

The judges ignored the pleas put forth by advocate Dushyant Dave to stay the suspension. 

M S Dhoni-led CSK and Rajasthan Royals were on July 14 suspended for two years from the IPL following the 2013 betting scam, involving their top officials Gurunath Meiyappan and Raj Kundra. The CSK, represented by its manager K George John, had moved the court on Thursday seeking to quash the Lodha Committee’s order and direct the BCCI to permit the CSK to participate in IPL matches.

The petitioner contended that neither the management of the CSK nor its players were found guilty of betting or match fixing. Besides the acts of Meyyappan, there was no finding against the franchise either in Justice Mudgal Committee Report or in the final order of the Supreme Court dated January 1, he added.
