HC rejects plea to probe TN ‘encounter killings’; directs to avail remedy under Human Rights Commission Act

Madras High court has rejected the plea to set up a Judicial Commission to probe alleged encounter deaths in the state and has suggested that the petitioner could avail the remedy under the Human Rights Commission Act.  

Hearing a plea by Henri Tiphagne, executive director of People’s Watch seeking a judicial commission to probe so-called ‘encounter deaths’ in Tamil Nadu, the First Bench comprising of Chief Justice S K Kaul and judge T S Sivagnanam said that the petition is general in nature and seeking to set up a separate mechanism under a retired judge would not be appropriate.

“We have the Human Rights Commission, both at the Centre and State. Any aggrieved party can easily access the Human Rights Commission for redressal in such a case and such cases are being examined by these commissions,” said the judges.

Tiphagne in his petition has also sought compensation to families of victims allegedly killed by the police in encounters and for the state government to initiate a domestic enquiry and direct the police to file FIR in every case of encounter killings. He has also alleged that in the last four years a total of 23 persons were purportedly killed by the state police in “encounters”.

“In fact, three persons have been killed in the first two months of 2010 alone. These cases reflect a pattern of consistent intentional and unchecked murder by the police officers of the state and disregard of the state in enforcing rule of law,” alleged Tiphagne.

“It is not a case where a specific instance is being sought to be canvassed as a case of encounter killing but having obtained certain information, seeking an enquiry as to what had actually happened and for award of appropriate compensation,” said the judges.

“We are of the view that if there are aggrieved persons, they may avail the remedy under the human rights Commission act rather than entertaining this petition seeking to set up judicial commission to go into the issue of alleged encounter killings in Tamil Nadu,” the judges said while dismissing the writ petition
