NSC Bose Road will be ‘No Hawking Zone’ says High Court

Chennai Corporation’s plan to have a Hawking Zone in NSC Bose Road linking Parry’s Corer and Flower Bazaar Police Station suffered a blow after Madras High Court ordered that the area should be ‘No-Hawking Zone’.

The Madras High Court bench comprising Chief Justice S K Kaul and Justice T S Sivagnanam on Tuesday directed the Chennai Corporation Commissioner and additional commissioner of traffic police to initiate action to clear the 

area from encroachment.

“The Chennai Corpopration Commissioner and additional commissioner of traffic police should maintain No-Hawking Zone in the area as per the existing Supreme court order,” said the judges while hearing a petition from activist Traffic Ramasamy.

Ramasamy in his petition has urged the High Court to direct the police and Chennai Corporation to comply with Supreme Court direction which has directed that Hawking cannot be permitted on NSCB Road. Ramasamy argued that the Hawking Zone would pose problems for pedestrians.  

Opposing the proposal to permit hawking in NSC Bose Road, the judges said since the earlier hawkers were rehabilitated there is no question of hawking zone in the no-hawking area.

The Court also said that Chennai Corporation should submit photographic evidence to show that the order is complied in letter and spirit.

It also directed Chennai Corporation to depute officers so that the hawking menace does not creep up. “The persons currently occupying the pavements are not entitled to do so, whether they are earlier hawkers or new ones,” the court observed
