Juvenile Court can only grant anticipatory bail

Could a juvenile seek a anticipatory bail before Madras High Court while bypassing the Juvenile Board.

“No” says Madras High Court. Observing that Juvenile Board is the only appropriate authority in dealing with bail proceedings of Juvenile, it stated that no other court has jurisdiction in granting bail to juveniles.

Justice S Vaidyanathan while hearing a anticipatory bail plea moved by a father of a juvenile apprehending arrest, said that the juvenile only if denied bail can appeal to Sessions Court or file a revision against the appelate order before the High Court.

The judge then dismissed the bail plea.
