After four years since the death of seven of year old girl Shruti of Zion Matriculation School in Selaiyur in a bus accident, several schools have approached Madras High Court over difficulties in the implementation of Tamil Nadu Motor Vehicles (Regulation and Control of School buses) Special Rules, 2012.
Passing interim orders on a batch of petitions from Tamil Nadu Nursery, Primary, Matriculation and Higher Secondary Schools Association and 8 others, the Full Bench comprising Chief Justice Sanjay Kishan Kaul, Justice V Ramasubramanian and Justice M M Sundresh asked the schools to list out the major problems which they perceive in implementation of the rules.
The state government introduced the Special rules in 2012 after Shruiti fell through a hole on the floor of her school bus and run over by another vehicle on July 26, 2012.
The full bench observed that the petitioners have agreed that it is not a adversarial litigation in view of safety of school children. However, they have expressed some difficulties in implementation, the bench said.
The petitioners should collectively submit major problem in implementation whi ch they perceive and the solution thereof, so that the same can be put to the state government,” the judges said.
The petitioners have stated that various provisions contained in the said Rules were inconsistent with and contrary to the provisions of Motor Vehicles Act and Central Motor Vehicles Rules.
The rules like the foot-board of the bus to be not less than 250mm and not more than 300mm was impractical as it could prove detrimental to the buses when it approaches s peed breakers, or negotiates p ot holes or bumpers etc.
Even, the insistence for separating driver’s cabin with grilled partition does not have any rationale as also the need for emergency exit on the rear side of the bus with quick release latches , which could prove unsafe.
