In a bid to ensure that accident victims get their due compensation, Madras High Court stipulated 23 set of guidelines for the claims tribunal, which is to come into effect from August 1.
The set of guidelines were passed by Justice R Sudhakar and S Vaidyanathan after ordering compensation to a youth who suffered nearly 100 per cent disability.
As per the guidelines proposed by Madras High Court, claims tribunal shall obtain and ensure bank account details of claimants. It also ordered that if the claimant adds a new person to his account, he should indicate his relationship to the person and the purpose of inclusion of his name.
The High Court also ruled that claims tribunal should obtain and ensure marking of pan card of all claimants wherever available. It should also confirm whether the claimant has Aadhar card and in case if he has then should mark a self attested copy of aadhar card.
For minor claimants, their bank account details should be obtained and marked with name of guardian specified. The account which is opened should have a suffix MACT to identify it is in relation to motor accident claims.
The insurance companies and transport corporations have to instruct banks to deposit award sums by way of direct bank transfer and send a copy of payment advise to claims tribunal.
