The state government has been directed to submit details about government land holdings in Thiruvallur and Kancheepuram districts and the extent of encroachment that have taken place within six weeks.
The First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice MM Sundresh gave the direction after hearing a public interest litigation filed by VBR Menon, an advocate of Madras High Court.
Menon wanted a creation of permanent special task force with adequate powers for removal of encroachments which the state had opposed on the grounds that officials are already taking action in removing encroachments
Stating that the submission by advocate general is contrary to what the petitioner pleads, the judges said that the Additional Advocate General has drawn the attention of the Court to the averments in the Counter affidavit that field Survey has already been carried and the details of all lands, including the Government lands have been registered in the revenue records
“The government must be knowing the extent of the encroachments on their land. We thus require a chart to be filed before us on the extent of Government holdings as per the records,” the judges observed.
The additional advocate general submitted that to begin with the Kancheepuram and Thiruvallur districts would be taken up, to which the judges agreed.
The aspect would be whether there is adequate material in Public domain to show the extent of Government lands and the methodology to detect the
encroachments and take action, they said.
