CMDA lacks transparency in providing info about illegal buildings

Chennai Metropolitan Development Authority has failed to provide details about the buildings where the violation is detected along with the list of violations despite the order of the Madras High Court to do so.



While CMDA has promised Madras High Court to put out entire details about the violation by the builders in its website, planners feel that not much transparency is being shown by CMDA while listing the violation of development control regulation by the builders.



Association of Professional Town Planners (APTP) president K M Sadanandh says that CMDA doesn’t share information on the nature of violation by the builder in constructing the building.



“We appreciate CMDA for publishing the list of locking, sealing and demolition notices issued to buildings or projects but then one should also want to know the nature of violations by builders,” says Sadanandh.



Interestingly, it was one of the issues which the Madras High has also highlighted in its order recently. The court has observed that buildings where violations is detected along with such violations has not been uploaded in the website.



Interestingly, the lack of transparency has resulted in many of the banks funding illegal construction which violate planning permission or doesn’t have permission to construct the building, says Sadanandh



Surprisingly, there has been instances where the sealed buildings are never brought down and some function illegally.



What is more surprising is that CMDA website has never provided details about the High Court appointed Monitoring Committee meeting after 2013. “A total of seven meetings were held but the minutes of the meeting never saw the light of the day,” said sources.



Even the Goernment Orders or Gazette notifications are also not uploaded. Even the GOs on the ill-fated Moulivakkam building was never uploaded on the website. Sources state that even the authority meetings, which change the land use plan and take most important decisions, hardly find a place in the website,” said Sadanandh.



It is not only CMDA, even the Chennai Corporation has faltered when it comes to putting up the list of illegal buildings. One of the owner whose building was sealed for minor violation in North Chennai had even got a favourable court order. “They did not deseal my premises. But a building which was sealed for major violation on the same day was desealed and the owner has constructed six floors illegally,” he alleged.
