TN rejects Reghupathi Commission recommendation to compensate Mouliakkam flat owners through SDRF funds

Tamil Nadu government has rejected the recommendation of Justice R Reghupathi Commission to compensate the flat buyers of the Moulivakkam building that collapsed last year killing more than 60 people.

The Commission, which was constituted under the Commission of Inquiry Act 1952 to look into the collapse of the building in Moulivakkam, in its recommendation has suggested that the government may form a committee so that the loss resulted to the individuals who booked the flats may be assessed and the government may fix compensation proportionate to the loss and damage.

It has suggested that the committee may fix compensation proportionate to the loss and damage for disbursal and the government may utilise the funds available under the ‘State Disaster Relief Fund’ for such purpose.

Interestingly, as per information available with Express, the state government has rejected the observation of the commission stating that guidelines of State Disaster Relief Fund does not permit it.

“Assessing loss and providing compensation to flat buyers and neighbouring residents affected by the mishap from SDRF is not feasible of compliance as the guidelines of SDRF do not permit it,” the state chief secretary K Gnanadesikan has stated in the Government Order.

Interestingly, the Government Order has stated that the government is exploring legal ways and means to assist flat buyers and the neighbouring residents to obtain compensation from those responsible for the loss.

Flats Affected Buyers Association said that it is 18 months since the building has collapsed but the flat buyers are still paying EMIs for the flats that don’t exist. “The government should intervene and ask banks to stop deducting EMIs as they can only resolve this issue,” says Manikandan. 

“All we require is compensation. Let the government go through the legal means but they have to ensure that the compensation is paid quickly,” he added.

Meanwhile, the government is also examining the suggestions put forth by the Raghupathi Comission to form a special unit to deal with underground transactions between officials and realtors
